A. SUMMARY OF TERMS OF USE AND PRIVACY POLICY
This section explains how we handle information; what we do, what we do not do, what we commit to, and what we cannot commit to as defined by law and by common sense (if legal). You can read the legal text below if you would like more details, but we also believe that it is useful to summarise here the two separate sections below: Terms of Use and the Privacy Policy.
• I) We do not use graphic or written material without permission, and naturally we cannot allow others to do so. We therefore kindly ask you to make reasonable use of the information published on www.linkhome.tv or on the websites accessible via this link. The information we offer on our websites is designed to be consulted by users and offer them information and guidance, and is public if they are public URLs, or private if they relate to material not geared towards public use. The user is of course not authorised to reuse or manipulate our materials for purposes other than those fulfilled by the Linkhome websites, and although they can forward the link to a Linkhome website to anyone, they are not authorised to manipulate any materials, extract information for commercial aims or unlawfully take advantage of work done by others.

3. Digital communications
Each time you use the Linkhome Service or send us an email, or contact us via a messenger service (SMS, message via Facebook, Whatsapp, etc.), you will be communicating with us by digital means. We will get in touch with you by means of the contact data that you have provided us, or by means of the publication of notices on our website, or by means of other Linkhome Services. In accordance with the Terms of this contract, you agree to receive communications from us by digital means, and accept that all of the notices, terms, notifications and communications fulfil any requirement demanded of a written communication, unless the law that is mandatorily applicable requires a different form of communication.

Use of the Websites is subject to said legally binding Terms and implies the acceptance of such and the obligation to act in accordance with such. Linkhome has been duly authorised by a third party to use different material on the Websites or has all of the copyrights relating to all of the material on the Websites. Linkhome also has all of the trademarks, commercial names, service names, logos or domain names used on the Websites or linked to such or holds due authorisation to use said material.

The reproduction of material from the Websites that Linkhome manages, of any type, as well as the manipulation and identification of graphic material of Linkhome clients or persons related to said clients, such as the use of photographs of a home labelling said material with information about the home, or personal information or information of any other type is expressly prohibited.

5. Registered trademarks and intellectual property claims

Linkhome's registered trademarks and commercial image (and in particular any design, in relation to any product or service that does not belong to Linkhome, not even in any format) that would be susceptible to causing confusion among the users or that could debase, discredit or in general cause any kind of confusion regarding the commercial trademarks that Linkhome uses, cannot be used. 6. Renunciation/limit of liability
Your use and browsing of the Websites falls under your liability. Linkhome, or any other party that represents Linkhome, or that is the parent company or subsidiary of such in the creation or presentation of the Websites, are not liable for any direct, indirect, special, punitive, incidental, and exemplary damages or damages resulting from the use you make of the Websites or the information contained therein.

If the cause were directly attributable to Linkhome, and was due to gross error or negligence, but not to wilful intent, you accept that Linkhome's liability will under no circumstances exceed the return of the price of the product or service contracted. This availability does not affect the client's right to receive the product or the rendering of the corresponding service as quickly as possible. Linkhome will also not under any circumstances be liable for any damages that a client believes has been caused to non-commercial aspects such as moral and psychological aspects or those of a similar nature, due to any cause, and particularly due to any problem resulting from the fact that the information available by means of websites, or by means of any mode of communication, has been interpreted by the client in manners not known or not set forth by Linkhome, except of course in the case of wilful intent.
7. Your account
If on any of the websites, you access the creation of a personal account to open a personal profile, or any similar action geared towards having customised access to some or all of the websites, when you use Linkhome's services, you are liable for keeping the details of your account and password confidential, and for sufficiently restricting access to your computing devices (computer, mobile telephone or any other by means of which you can access personal information) from other people. 8. Content uploaded by the user (opinions, comments, communications and other content) and Linkhome software
You and any other user of Linkhome's websites can publish opinions, comments, suggestions, ideas or other content and upload information to Linkhome's Websites, or those managed by Linkhome, if the websites are equipped for and permit this. Whether you are a client of Linkhome or not, we will try to attend to any information or request for information that you send to us by digital means. However, you accept that Linkhome does not have any obligation or hold any liability, other than that legally valid in Spain, to respond to your publication of content or request for information.
This is particularly applicable to any request for information, claim or communication made by means of channels of communication other than email available on www.linkhome.tv. On publishing any content or uploading any information or material to the Websites managed by Linkhome, and unless there is an explicit agreement in place stating otherwise, you grant Linkhome the non-exclusive right to use, reproduce, modify, adapt, publish, translate, create and use any derivative works and distribute and display your content throughout the world and by any means, while observing intellectual property rights. You also grant Linkhome the right to use the name you provided in relation to said content.
When uploading any content to the websites that Linkhome manages, you state and accept that you are the owner of the rights that can be attributed to the content published, or you are expressly authorised to use such, in which case you must indicate this. This includes the design of the information and the graphic design associated with the software. Linkhome is not liable for the websites of third parties accessed by means of links that the Websites lead to or are derived from, including the possibility that said links are an error or they have been subject to a hacking technique to direct the user towards a product or service with some defect. Linkhome does not support any website, goods or service offered by said websites. Linkhome declines any responsibility relating to the precision of any information from said websites and from any good or service offered or that can be bought on said websites.
10. Accuracy of the information
Linkhome takes measures to guarantee the accuracy of the information on the Websites. However, Linkhome does not accept liability for errors or omissions in the content of the Websites and beyond criteria of reasonable diligence, it does not guarantee the accuracy, integrity or up-to-date nature of the information on the Websites, particularly with regard to prices, characteristics of products or services, and in general any type of information that may contain an error.
The information about such is subject to changes that can be made at any time and without prior notification. You expressly accept that in the event of incorrect information, Linkhome will not be contractually bound, under any circumstances or by any means, by these possible errors or modifications although Linkhome will try to adequately inform you of the event and of the possibility to proceed with the usage in question, with the correct information.
11. Non-renunciation
Linkhome's failure to enforce the fulfilment of any of said Terms will not constitute the renunciation of any of the rights of Linkhome mentioned in this text resulting from past or future actions.
12. Jurisdiction
Any disputes that may arise resulting from the content or use of the Websites shall be governed by Spanish laws and with regard to the jurisdiction and the place of jurisdiction, only the courts of the city of Madrid (Spain) will be competent to settle any type of action.
13. Prices
Prices and availability: all of the prices detailed on the Websites managed by Linkhome that refer to products or services that Linkhome offers, or are related to third parties, include the legally applicable taxes (VAT included) unless otherwise stated. In the event that Linkhome publishes a price for a product or service, said publication does not involve any obligation on the part of Linkhome or on the part of a third party related to Linkhome, and you, as a user, declare that you agree with this. These prices are reported for informative purposes and under no circumstances shall they have contractual value. The knowledge and acceptance of these Terms together with our Privacy Policy, constitutes a full agreement between you and Linkhome with regard to the use of the Websites, and regarding the relationship that the information accessible via the websites may have with other kinds of direct contractual relationship between any natural or legal person and Linkhome.
Linkhome could change said Terms at any time by means of the publication of the changes on the Websites. Said changes will be made effective immediately after their publication on the Websites. Use of the Websites involves your conformity with any modified Term.
The Websites do not aim to provide any information that affects your health. b. Non-personal information

In the event that any type of information about third parties that you send us is protected by a copyright, registered trademark or any type of patent rights or similar; or in the event such contains graphic, written or audiovisual information about third parties, you undertake to compensate, defend and waive LINKHOME, its parent companies, subsidiaries and/or branches, and its respective workers, directors, employees, agents, licensors, representatives and third party suppliers (jointly referred to as the “LINKHOME Indemnified”) of any liability, in the event that claims, or actions against any of the LINKHOME Indemnified are filed because of or in relation to the use or possession of said Information.
5. Security
We keep the information we gather on the servers by fulfilling the security measures required by Spanish legislation in relation to data protection, to protect your Personal Information. However, we cannot fully guarantee complete security, and this does not mean that our level of security fulfils or exceeds any type of specific standard (in addition to those required by data protection legislation).
Sending data on the Internet is not 100% secure or free of errors and the data saved is vulnerable. It is not possible to fully and completely guarantee the security of our websites, databases or services and we also cannot guarantee that the information you send us will not be intercepted while you are sending it to us over the Internet.
